He got no protection from the Whistleblower Act and the FBI knowingly bypassed the lawyer of a represented client

Richard Pollock has this report at The Daily Caller that has me fuming.

FBI agents raided the home of a recognized Department of Justice whistleblower who privately delivered documents pertaining to the Clinton Foundation and Uranium One to a government watchdog, according to the whistleblower’s attorney.

The Justice Department’s inspector general was informed that the documents show that federal officials failed to investigate potential criminal activity regarding former Secretary of State Hillary Clinton, the Clinton Foundation and Rosatom, the Russian company that purchased Uranium One, a document reviewed by The Daily Caller News Foundation alleges.

The delivered documents also show that then-FBI Director Robert Mueller failed to investigate allegations of criminal misconduct pertaining to Rosatom and to other Russian government entities attached to Uranium One, the document reviewed by TheDCNF alleges. Mueller is now the special counsel investigating whether the Trump campaign colluded with Russia during the 2016 election.

“The bureau raided my client to seize what he legally gave Congress about the Clinton Foundation and Uranium One,” the whistleblower’s lawyer, Michael Socarras, told TheDCNF, noting that he considered the FBI’s raid to be an “outrageous disregard” of whistleblower protections.

Sixteen agents arrived at the home of Dennis Nathan Cain, a former FBI contractor, on the morning of Nov. 19 and raided his Union Bridge, Maryland, home, Socarras told TheDCNF.

The raid was permitted by a court order signed on Nov. 15 by federal magistrate Stephanie A. Gallagher in the U.S. District Court for Baltimore and obtained by TheDCNF.

A special agent from the FBI’s Baltimore division, who led the raid, charged that Cain possessed stolen federal property and demanded entry to his private residence, Socarras told TheDCNF.

“On Nov. 19, the FBI conducted court-authorized law enforcement activity in the Union Bridge, Maryland area,” bureau spokesman Dave Fitz told TheDCNF. “At this time, we have no further comment.”

Cain informed the agent while he was still at the door that he was a recognized protected whistleblower under the Intelligence Community Whistleblower Protection Act and that Justice Department Inspector General Michael Horowitz recognized his whistleblower status, according to Socarras.

Cain further told the FBI agent the potentially damaging classified information had been properly transmitted to the Senate and House Intelligence committees as permitted under the act, Socarras said. The agent immediately directed his agents to begin a sweep of the suburban home, anyway.

Frightened and intimidated, Cain promptly handed over the documents, Socarras told TheDCNF. Yet even after surrendering the information to the FBI, the agents continued to rummage through the home for six hours.

“After asking and getting my approval to do so, DOJ IG Michael Horowitz had a member of his staff physically take Mr. Cain’s classified document disclosure to the House and Senate Intelligence committees,” Socarras told TheDCNF.

“For the bureau to show up at Mr. Cain’s home suggesting that those same documents are stolen federal property, and then proceed to seize copies of the same documents after being told at the house door that he is a legally protected whistleblower who gave them to Congress, is an outrageous disregard of the law,” he continued.

Cain came across the potentially explosive information while working for an FBI contractor, Socarras told TheDCNF.

Cain met with a senior member of Horowitz’s office at a church close to the White House to deliver the documents to the IG, according to Socarras.

Cain sat in a pew with a hoodie and sunglasses, Socarras said. Cain held a double-sealed envelope containing a flash drive with the documents. The IG official met him and, without saying a word, took the pouch over Cain’s shoulder and left.

The law protects whistleblowers who are government contractors and requires the IG to share such potentially damaging information with the attorney general — who at the time was Jeff Sessions.

The two law enforcement officials directed the documents be sent to the Senate and House Intelligence committees for their examination, according to Socarras, who said that a high-level IG official hand-delivered the documents to the two intelligence committees.

“I cannot believe the Bureau informed the federal magistrate who approved the search warrant that they wanted to search the home of an FBI whistleblower to seize the information that he confidentially disclosed to the IG and Congress,” Socarras told TheDCNF.

The whistleblower act is intended to protect whistleblowers within the intelligence community, which includes the FBI.

“The [intelligence community] is committed to providing its personnel the means to report violations of law,” according to a 2016 intelligence community directive.

“The [whistleblower act] authorizes employees of contractors to take government property and give it to the two intelligence committees confidentially,” Socarras told TheDCNF.

The FBI has yet to talk to Cain’s attorney despite the raid, according to Socarras.

“After the raid, and having received my name and phone number from Mr. Cain as his lawyer, an FBI agent actually called my client directly to discuss his seized electronics,” Socarras told TheDCNF. “Knowingly bypassing the lawyer of a represented client is serious misconduct.”

The Justice Department and the IG both declined to comment.

"Core values were at stake. Why didn’t Mr. Obama say anything?"

James Freeman writes in the Wall Street Journal,

...Presidents traditionally try to avoid criticizing their successors. Mr. Obama suggested before leaving office that he would only comment publicly when “core values may be at stake.” Since leaving the White House he has occasionally addressed issues of federal policy including immigration, health care and climate change. But Mr. Obama has had little or nothing to say about the issue that has so fascinated many of his fellow Democrats: the claim that Donald Trump somehow colluded with the Russians to rig the 2016 election.

This column noted in April that Mr. Obama’s decision not to address the issue in his post-presidency was fairly strong circumstantial evidence that, having had unparalleled access to the relevant intelligence, he didn’t think there was anything to it. After all, if our former commander-in-chief believed that a foreign government had essentially staged a silent coup in the United States, how could this not rise to the level of a threat to core values?

...A report today in The Hill suggests that Mr. Obama may not simply have concluded that there was nothing to the allegations against the Trump campaign. He may have also decided that a close inspection of U.S.-Russian relations would not be kind to the Obama Administration--and especially to its State Department during the early years of his presidency.

According to The Hill:

"Before the Obama administration approved a controversial deal in 2010 giving Moscow control of a large swath of American uranium, the FBI had gathered substantial evidence that Russian nuclear industry officials were engaged in bribery, kickbacks, extortion and money laundering designed to grow Vladimir Putin’s atomic energy business inside the United States, according to government documents and interviews.
Federal agents used a confidential U.S. witness working inside the Russian nuclear industry to gather extensive financial records, make secret recordings and intercept emails as early as 2009 that showed Moscow had compromised an American uranium trucking firm with bribes and kickbacks in violation of the Foreign Corrupt Practices Act, FBI and court documents show.

They also obtained an eyewitness account — backed by documents — indicating Russian nuclear officials had routed millions of dollars to the U.S. designed to benefit former President Bill Clinton’s charitable foundation during the time Secretary of State Hillary Clinton served on a government body that provided a favorable decision to Moscow, sources told The Hill."

This bombshell suggests that the ugly transactions revealed by “Clinton Cash” author Peter Schweizer were even uglier than they appeared when he broke the news in 2015. Back then the story appeared to be the Clintons helping out their wealthy friends to cut a sweet uranium deal with a Kazakh dictator while failing to properly disclose donations to the Clinton Foundation. As if that didn’t smell bad enough, now we have a report that the Russians were also trying to funnel cash to the Clintons. The Russians eventually got what they wanted from the U.S. government—control of a large uranium stockpile.

And the story gets worse, according to The Hill. Today’s report says that even after uncovering the Russian schemes, a part of the Obama Administration that was not being run by a Clinton didn’t act on the information:

"Rather than bring immediate charges in 2010, however, the Department of Justice (DOJ) continued investigating the matter for nearly four more years, essentially leaving the American public and Congress in the dark about Russian nuclear corruption on U.S. soil during a period when the Obama administration made two major decisions benefiting Putin’s commercial nuclear ambitions."

Another timely suicide who was expected to expose Clinton Foundation corruption next week

Are you getting tired of reading about "suicides" of people who have damaging information on the Clintons? Baxter Dmitry reports at Your Newswire,

Klaus Eberwein, a former Haitian government official who was expected to expose the extent of Clinton Foundation corruption and malpractice next week, has been found dead in Miami. He was 50.

Eberwein was due to appear next Tuesday before the Haitian Senate Ethics and Anti-Corruption Commission where he was widely expected to testify that the Clinton Foundation misappropriated Haiti earthquake donations from international donors.

According to Miami-Dade’s medical examiner records supervisor, the official cause of death is “gunshot to the head“. Eberwein’s death has been registered as “suicide.”

Eberwein, who had acknowledged his life was in danger, was a fierce critic of the Clinton Foundation’s activities in the Caribbean island, where he served as director general of the government’s economic development agency, Fonds d’assistance économique et social, for three years.

According to Eberwein, a paltry 0.6% of donations granted by international donors to the Clinton Foundation with the express purpose of directly assisting Haitians actually ended up in the hands of Haitian organizations. A further 9.6% ended up with the Haitian government. The remaining 89.8% – or $5.4 billion – was funneled to non-Haitian organizations.

“The Clinton Foundation, they are criminals, they are thieves, they are liars, they are a disgrace,” Eberwein said at a protest outside the Clinton Foundation headquarters in Manhattan last year.

The former director general of Haiti, who also served as an advisor to Haitian President Michel Martelly, was also a partner in a popular pizza restaurant in Haiti, Muncheez, and even has a pizza — the Klaus Special — named after him.

According to the Haiti Libre newspaper, Eberwein was said to be in “good spirits“, with plans for the future. His close friends and business partners are shocked by the idea he may have committed suicide.

“It’s really shocking,” said Muncheez’s owner Gilbert Bailly. “We grew up together; he was like family.”

Bailly said he last spoke to Eberwein two weeks ago and he was in good spirits. They were excited about future business plans and were working on opening a Muncheez restaurant in Sunrise, he said.

The Haitian government issued an official notice thanking Eberwein for his service and mourning his untimely death.

“The Directorate General of FAES presents its sympathies to the bereaved families, friends and collaborator that this mourning afflicts. The FAES flag will be flown at half-mast from Wednesday 12th to Tuesday 18th July 2017. May his soul rest in peace,” Charles Ernest Chatelier, director general.

Peterson previously worked for the Colorado Human Trafficking Council’s Data & Research Task Force. Early in 2016, a friend shared her blog post which was critical of Hillary Clinton’s shady dealings in Haiti."

Use the “RAPE” word—you missed this opportunity in the debate. You made your point, but missed tossing a spear into Clinton’s heart. Did you happen to see the “Scoobie Doo” (‘ruh-rooh!’) look on Bill Clinton’s face when you brought up the subject.

Had the “rape” word been used on TV, live, unedited and uncensored the whole narrative and a massive landslide of opinion would have completely shifted onto Bill and Hillary Clinton.

...Excellent move springing Bill’s victims on an unsuspecting MSM press pre-debate. We old political timers know about Bill’s sins and crimes going back over a generation—but the younger generation have no idea what went on with the Clintons prior to 2005.

Hammer home the “rape” and “assault” words with Bill Clinton and Hillary’s persecution of Bill’s victim (so she could ride his coat-tails later into some sort of political career for herself). The American people need to hear it—not the puff-ball yim-yammer from the candidates as in past elections.

In fact, Hillary Clinton’s Sate Department criticized the Arab nation for its “lack of equal rights for women and children” and said human trafficking and violence against women are “common” in that country. Nevertheless, the Clinton Foundation has accepted tens of millions of dollars from Saudi Arabia over the years.

Anti-LGBT Russia: Bill Clinton earned $500,000 for a speech in Moscow paid for by a Kremlin-backed bank

As first documented in Clinton Cash, the former president bagged $500,000 for a single Moscow speech paid for by a Russian investment bank that had ties to the Kremlin.

The tiny Arab nation was ripped by Hillary Clinton’s State Department for its many human rights abuses, including the government’s interference “with privacy and to restrict civil liberties, including usage of the Internet.” Despite reports of public floggings and a ban on “all sexual acts outside of heterosexual marriage,” the Clinton Foundation still accepted millions from the UAB.

The Nation of Brunei donated $1,000,000 to $5,000,000 to the Clintons

Hillary Clinton’s troubled charity was taking in millions of dollars in contributions from the nation of Brunei, all while her State Department was citing the tiny Asian country for a multitude of human rights abuses, including, “restrictions on religious freedom; exploitation of foreign workers; and limitations on freedom of speech, press, assembly … and discrimination against women.”

Kuwait donated $5,000,000 to $10,000,000 to the Clintons

This oil-rich nation was also reprimanded by Hillary Clinton’s State department for its various “human rights problems.” And Kuwait’s policy to imprison gays for up to seven years notwithstanding, the Clinton Foundation still accepted its major donation.

Qatar donated $1,000,000 to $5,000,000 to the Clintons

According to Qatar’s penal code, the penalty for the crime of homosexual sex is up to seven years in prison. The Arab nation also has “continuing human rights concerns,” according to a report released by Hillary Clinton’s State Department. Those human rights restrictions include “freedom of religion … trafficking in persons … legal, institutional, and cultural discrimination against women limited their participation in society.”

Keep the lefty newsreaders out of it.

Intermingling of access and donations

More than half the people outside the government who met with Hillary Clinton while she was secretary of state gave money - either personally or through companies or groups - to the Clinton Foundation. It's an extraordinary proportion indicating her possible ethics challenges if elected president.

...the frequency of the overlaps shows the intermingling of access and donations, and fuels perceptions that giving the foundation money was a price of admission for face time with Clinton. Her calendars and emails released as recently as this week describe scores of contacts she and her top aides had with foundation donors.

...Clinton met with representatives of at least 16 foreign governments that donated as much as $170 million to the Clinton charity, but they were not included in AP's calculations because such meetings would presumably have been part of her diplomatic duties.

...more than 6,000 donors who have already provided the Clinton charity with more than $2 billion in funding since its creation in 2000.

"There's a lot of potential conflicts and a lot of potential problems," said Douglas White, an expert on nonprofits who previously directed Columbia University's graduate fundraising management program. "The point is, she can't just walk away from these 6,000 donors."

Former senior White House ethics officials said a Clinton administration would have to take careful steps to ensure that past foundation donors would not have the same access as she allowed at the State Department.

...GOP Vice Presidential candidate Indiana Gov. Mike Pence said the AP analysis was evidence of "pay-to-play" politics at Clinton's State Department. He called for the foundation to be shut down and for an independent prosecutor to be appointed to investigate.

State Department Preferential treatment for donors to Clinton Foundation

Judicial Watch today released 725 pages of new State Department documents, including previously unreleased email exchanges in which former Hillary Clinton’s top aide Huma Abedin provided influential Clinton Foundation donors special, expedited access to the secretary of state. In many instances, the preferential treatment provided to donors was at the specific request of Clinton Foundation executive Douglas Band.

Detecting semantic hijinks

Ann Althouse is a self-professed "detector of semantic hijinks," and proves it (to me) as she detects the semantic hijinks of the New York Times in their pieces today on the Trump "empire" and the Clinton Foundation.

Putting the articles together makes an implicit statement that the NYT is applying its investigative powers in a professional journalistic fashion to both candidates and delving into the questions about the nature of their wealth and their financial dealings. Putting the Trump article in larger print and on top conveys the impression that the investigation into him turned up more serious problems.

So does the language used.

The words "Trump's Empire" parallel "Foundation Donor's." It doesn't even say "Clinton Foundation." The name "Clinton" is used in "Clinton's Candidacy," which faces "obstacles." The active characters are the donors, raising obstacles for her candidacy (not even directly for her, but for the abstraction that is her candidacy). See all that distancing? She's essentially the hero of that headline, with a worthy goal and facing obstacles from other characters. Read the finer print too. See how she's the hero? A classic hero is even named: Achilles! And speaking of names, none of the donors are named. You have to click through to find the worrisome list: Saudi Arabia, the United Arab Emirates, Qatar, Kuwait, Oman, Brunei and Algeria.

But Trump has an "empire" — that doesn't sound American — and his empire has "hazy ties" — sounds spurious! — and $650 million in debt. That sounds like a lot of money! No dollar amount is specified in the headline or the squib about the Clinton foundation. The Trump debt is presumably owed to banks as part of a huge, ongoing real estate enterprise, so I don't know what's nefarious about that, but I guess something is "hazy," and it looks like he might have grossly misstated the debt in the federal electing filing, though the use of the word "apparent" — in "nearly twice the amount apparent in his federal election filing" — makes me (a detector of semantic hijinks) suspect semantic hijinks.

So, let's finally click through and see how these 2 stories compare. The one on Hillary is called "Foundation Ties Bedevil Hillary Clinton’s Presidential Campaign." This is by Amy Chozick and Steve Eder.

Ann reads the 2 stories, observes the semantic hijinks, and concludes,

Trump has been building his family company over many decades, accumulating great wealth. The Clinton family has amassed wealth — not as much, but within a short time and using the prestige and influence of the past presidency of the husband and the promise of a future presidency for the wife.

If you ran a newspaper, like the NYT, how would you balance coverage of the 2 stories? I'd say the Clinton problem is more worrisome, but the Trump article is longer and more detailed, which justifies giving it top billing on the front page. It's almost as if the Clinton article was generated to go along with it, to give the appearance of balance the in-depth investigation of Trump.

ABC and NBC's evening newscasts on Thursday barely mentioned the Clinton Foundation's announcement that it would stop accepting foreign and corporate donations if Hillary Clinton is elected president. ABC's World News Tonight set aside 25 seconds of air time to the news at the end of a full report on the Donald Trump campaign preparing for the billionaire's first presidential debate with Hillary Clinton. NBC Nightly News devoted 26 seconds to the story immediately before a minute and half-long segment on the Clinton campaign blasting "conspiracy theories" about the Democrat's health.

CBS Evening News didn't cover the story until Friday. However, unlike its competitors at ABC and NBC, the program aired a full report on the Clinton Foundation's move that lasted one minute and 42 seconds.

The Clinton Foundation was not part of the recent investigation into her private server; it was separate. The FBI went to Justice Department earlier this year asking for it to open a case into the foundation, but the public integrity unit declined. The Justice Department had looked into whether it should open a case on the foundation a year prior and found it didn't have sufficient evidence to do so.

Remember those? We had them under Republican presidents. It's where the President has to appoint someone from outside his coterie of cronies to investigate himself or his cronies. We don't have those under Democrat presidents, who prefer having their own cronies "investigate" them.

It will, indeed, be a black eye for the GOP.

But it will be a victory for the Rule of Law and a vindication of the American Republican System of Government.

And what happens when Hillary similarly breaks the law, then has her crony Loretta Lynch say "no controlling legal authority," and completely gets away with it?

Which outcome sounds worse to you? Which will be more corrosive to America itself -- the rule of law triumphant, or the rule of law humiliated, stripped of its clothes, and raped on the floor?

We are literally witnessing the end of the Republic itself, and yet people prefer to dwell on smaller things (maybe because smaller things are comforting; if you dwell on small things, you can convince yourself nothing major is amiss) and just shrug at the end of the Republic.

By the way: CNN buried the lede at the end of their story. Drudge had to elevate it to the actual headline news it is.

So, hey. Let's all coronate queen Hillary and her united media, federal bureaucracy, Supreme Court, and permanent Clinton-Industrial Complex.

There's nothing at all wrong with power with no checks whatsoever -- that's Article 1, Section 1 of the Constitution, isn't it?

Treason never prospers, for if it prospers, then none dare call it treason.

The Clinton Foundaton: organized crime at its finest

Recently, Charles Krauthammer alluded that he had no doubt some of the 30k emails Hillary deleted from her private e-mail server very likely had references to the Clinton Foundation, which would be illegal and a conflict of interest.
The Clinton Foundation is "organized crime" at its finest.

Here is a good, concise summary of how the Clinton Foundation works as a tax free international money laundering scheme. It may eventually prove to be the largest political criminal enterprise in U.S. History.
This is a textbook case on how you hide foreign money sent to you and repackage it to be used for your own purposes. All tax free.

Here's how it works:
1. You create a separate foreign "charity." In this case, the Clintons set it up in Canada.

2. Foreign oligarchs and governments, then donate to this Canadian charity. In this case, over 1,000 did –contributing mega millions. I'm sure they did this out of the goodness of their hearts, and expected nothing in return. (Imagine Putin's buddies waking up one morning and just deciding to send untold millions to a Canadian charity).

3. The Canadian charity then bundles these separate donations and makes a massive donation to the Clinton Foundation.

4. The Clinton Foundation and the cooperating Canadian charity claim Canadian law prohibits the identification of individual donors.

5. The Clinton Foundation then "spends" some of this money for legitimate good works programs. Unfortunately, experts believe this is on the order of 10%. Much of the balance goes to enrich the Clintons, pay salaries to untold numbers of hangers on, and fund lavish travel, etc. Again, virtually tax free, which means you and I are subsidizing it.

6. The Clinton Foundation, with access to the world's best accountants, somehow fails to report much of this on their tax filings. They discover these "clerical errors" and begin the process of re-filing 5 years of tax returns.

7. Net result – foreign money goes into the Clinton 's pockets tax free and untraceable back to the original donor. This is the textbook definition of money laundering. Oh, by the way, the Canadian "charity" includes as a principal one Frank Giustra. Google him. He is the guy who was central to the formation of Uranium One, the Canadian company that somehow acquired massive U.S. Uranium interests and then sold them to an organization controlled by Russia. This transaction required U.S. State Department approval, and guess who was Secretary of State when the approval was granted.

As an aside, imagine how former Virginia Governor Bob McDonnell feels. That poor schlep is in jail because he and his wife took $165,000 in gifts and loans for doing minor favors for a guy promoting a vitamin company. Not legal but not exactly putting U.S. Security at risk.

Sarcasm aside, if you're still not persuaded this was a cleverly structured way to get unidentified foreign money to the Clintons, ask yourself this: Why did these foreign interests funnel money through a Canadian charity? Why not donate directly to the Clinton Foundation? Better yet, why not donate money directly to the people, organizations and countries in need?

This is the essence of money laundering…and influence peddling. Now you know why Hillary's destruction of 30,000 e-mails was a risk she was willing to take. Bill and Hillary are devious, unprincipled, dishonest and criminal and they are Slick!

Warning: They could be back in the White House in January 2017.
