🚨 USDOL Alert for Employers: Key FLSA Updates The U.S. Department of Labor released its Semiannual Regulatory Agenda yesterday and appears to be set on sharpening its focus on three major areas under the Fair Labor Standards Act (FLSA): 👥 Joint Employer Liability - The DOL will look at the circumstances under which a business can be held liable as a joint employer. 🧑💼 Employee vs. Independent Contractor - The DOL will examine the circumstances under which a worker should be classified as an employee or independent contractor for the purpose of federal wage and hour requirements. 💼 White-Collar Exemptions - The DOL will determine whether certain salaried employees are exempt from FLSA minimum wage and overtime requirements. 📌 Employers should closely track these developments—potential changes could impact compliance strategies. 🔗 Full DOL Announcement below https://lnkd.in/ecZKqxSi

Personally, I’ve found it helpful to break the process down into simple, sequential steps. While there are plenty of fact-specific nuances and exceptions to this chart, this visual is one way to organize the key decision points in a very complex area. NYC Employers: Prenatal Leave Rules Have Been Updated. The NYC Department of Consumer and Worker Protection recently updated its rules under the Earned Safe and Sick Time Act to align with New York State’s Paid Prenatal Leave Law, which took effect earlier this year. While this isn’t a new category of leave, it does mean NYC employers now have additional responsibilities when it comes to administering paid prenatal time off. To recap: under state law, employees are entitled to up to 20 hours of paid prenatal leave per year for healthcare services related to pregnancy. With the updated NYC rules, employers should now: • Provide regular updates to employees, each pay period, how many prenatal leave hours they’ve used and what’s remaining. This can be included on the pay stub or provided separately. • Maintain clear records – Document the dates, hours used, and payments made for any prenatal leave taken. • Share updated policies and distribute your prenatal leave policy at onboarding, when changes are made (within 14 days), and upon request. • The NYC “Notice of Employee Rights” now includes paid prenatal leave so you'll want to use the current version. This is a good opportunity to check that your leave policies and systems are aligned with both state and city requirements.

🚨 𝗕𝗶𝗴 𝘄𝗶𝗻 𝗳𝗼𝗿 𝗲𝗺𝗽𝗹𝗼𝘆𝗲𝗿𝘀 𝗶𝗻 𝘄𝗮𝗴𝗲 𝗮𝗻𝗱 𝗵𝗼𝘂𝗿 𝗲𝗻𝗳𝗼𝗿𝗰𝗲𝗺𝗲𝗻𝘁. As of June 27, 2025, the U.S. Department of Labor’s Wage & Hour Division (WHD) can no longer demand liquidated damages during an administrative investigation under the Fair Labor Standards Act (FLSA). In plain English: if the DOL investigates your company for unpaid minimum wage or overtime, it can still seek 𝗯𝗮𝗰𝗸 𝘄𝗮𝗴𝗲𝘀—but 𝗻𝗼𝘁 𝗱𝗼𝘂𝗯𝗹𝗲 𝗱𝗮𝗺𝗮𝗴𝗲𝘀—unless it takes you to court. 💥 𝗪𝗵𝗮𝘁 𝗰𝗵𝗮𝗻𝗴𝗲𝗱? Before this new Field Assistance Bulletin, WHD regularly asked employers to pay 𝗯𝗼𝘁𝗵 back pay and an equal amount in liquidated damages—even without filing a lawsuit. That practice is now off-limits. FAB 2025-3 makes it crystal clear: ➡️ No liquidated damages in any WHD-supervised settlement ➡️ No negotiation leverage using potential litigation damages ➡️ No role for the Solicitor’s Office in seeking those damages unless a lawsuit is filed ⚖️ 𝗪𝗵𝘆 𝘁𝗵𝗶𝘀 𝗺𝗮𝘁𝘁𝗲𝗿𝘀 𝘁𝗼 𝗲𝗺𝗽𝗹𝗼𝘆𝗲𝗿𝘀 ✅ Lower settlement costs: No more paying twice just to avoid litigation. ✅ Faster resolutions: The DOL’s own data showed that adding liquidated damages delayed settlements by 28%. ✅ More leverage: Employers can now negotiate settlements based on actual back wages owed—without the fear of automatic penalties. But this doesn’t change the fact that liquidated damages are still fully available in: 🔹 Private lawsuits under the FLSA 🔹 Cases where the DOL chooses to litigate 🔹 State wage investigations, which are not impacted by this change at all 🛡️ 𝗪𝗵𝗮𝘁 𝘀𝗺𝗮𝗿𝘁 𝗲𝗺𝗽𝗹𝗼𝘆𝗲𝗿𝘀 𝘀𝗵𝗼𝘂𝗹𝗱 𝗱𝗼 𝗻𝗲𝘅𝘁 This is a policy shift, not a compliance shortcut. Your best defense is still a good offense: 🔍 Audit your pay practices 📋 Review exemption classifications 🧠 Train managers on wage and hour rules 🛠️ Fix problems early—before they attract outside attention 💡 𝗕𝗼𝘁𝘁𝗼𝗺 𝗹𝗶𝗻𝗲: If you’re under federal investigation for wage issues, now is a smart time to resolve it. With liquidated damages off the table unless there's a lawsuit, the cost of settlement just got a lot more reasonable. And if you're not under investigation?
